Metro Sports LLC - Responsibility Waiver - Hold Harmless Agreement [English]
With full knowledge and understanding, I certify that I acknowledge the following:

1) That my name and other circumstances are as described in this waiver form.
​
2) That I recognize that the risk of injury from the activities involved in this program, in which we are participating freely and voluntarily, is significant, including the potential for serious injury, affecting bodily integrity, and even causing death.
​
3) Therefore, with full knowledge of the consequences of my actions, and as a representative of the team described above, I WILL ASSUME AND TAKE INTO ACCOUNT ALL TYPES OF RISKS, BOTH KNOWN AND UNKNOWN, EVEN IF THEY ARISE FROM THE NEGLIGENCE OF THE LAUNCHES or others, and I assume full responsibility for my participation in this event.

4) I acknowledge my obligation to abide by and comply with the established and customary terms and conditions for participation in this sport. However, if I observe any significant unusual hazard during my presence or participation, I will refrain from participating and will immediately bring it to the attention of the nearest official in charge of Metro Sports, LLC, or the facility where the event is taking place.

5) I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE FROM LIABILITY to Metro Sports LLC its directors, officers, agents, volunteers and/or employees, other participants, sponsoring agencies, sponsors, advertisers and, if applicable, owners and lessors of premises used to conduct the event ("RELEASES"), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, OR LOSS OR DAMAGE TO PERSON OR PROPERTY, WHETHER NEGLIGENT IN COMMUNICATIONS OR OTHERWISE, to the fullest extent permitted by law.

6) Likewise, it grants the corresponding permission for purposes of authorizing the taking of photos, recording images and other similar promotional processes that the company Metro Sports, LLC may use. I hereby authorize Metro Sports LLC and its partners to use my personal image, name, photos, video, and other representations of myself for marketing purposes related to the leagues and products offered by Metro Sports LLC.

7) This release of liability shall be governed by the laws and courts of the Commonwealth of Puerto Rico. In the event that any provision of this document is declared null or invalid, it will continue in full force and effect in everything that is not incompatible with that part that has been declared null or invalid under the law.

8) This release of liability shall be binding on the party and its successors.
9) I acknowledge that Metro Sports, LLC has not made any promises or representations to me, other than those indicated herein, and that if I sign it it is not because I am relying on promises or representations not included in this writing. I acknowledge that I assume the risk of any errors of fact, known or not, and that I understand and acknowledge the meaning and consequences hereof, and represent that I understand and voluntarily accept its terms and conditions.
10) Therefore, in consideration of the foregoing, I release and absolve in perpetuity Metro Sports, LLC for any and all claims, suits, actions, causes of action in law or equity, debts, sums of money, contracts, promises and claims in damages that you may have, the legal partnership of gains, if any, your spouse, your heirs, executor, directors, successors in interest, assigns and dependents may have or may have in the past against Metro Sports, LLC for any incident that alleges suffered damages.
11) The undersigned herein acknowledge and affirm that, having had sufficient time to read carefully, they fully understand all the provisions of this document, as well as the consequences thereof. In addition, they agree that they have not relied on or relied on any representation or statement made that is not expressly stated in writing herein, which is why they accept it freely and voluntarily.

Con pleno conocimiento y entendimiento, certifico que reconozco lo siguiente:

​1) Que mi nombre y demás circunstancias son las antes descritas.
2) Que reconozco que el riesgo de lesión por las actividades involucradas en este programa, del cual estamos participando de forma libre y voluntaria, es significativo, incluyendo el potencial de lesiones graves, que afeten la integridad corporal, y hasta pudiera causar la muerte.
3) Por ende, con pleno conocimiento de las consecuencias de mis actos, y en calidad de representante del equipo arriba descrito, ASUMIRÉ Y TENDRÉ EN CUENTA TODO TIPO DE RIESGOS, tanto conocidos como desconocidos, INCLUSO SI SURGEN DE LA NEGLIGENCIA DE LOS LANZAMIENTOS u otros, y asumo la plena responsabilidad de mi participación en este evento.
4) Reconozco mi obligación de acatar y cumplir con los términos y condiciones establecidos y habituales para la participación de este deporte. Sin embargo, si observo algún peligro inusual significativo durante mi presencia o participación, me abstendré de participar y lo llamaré inmediatamente a la atención del funcionario más cercano encargado de Metro Sports, LLC, o de la facilidad en donde se esté llevando a cabo el evento.
5) Yo, para mí y en nombre de mis herederos, cesionarios, representantes personales y parientes más cercanos, POR ESTE MEDIO RELEVO DE RESPONSABILIDAD a Metro Sports LLC sus directores, funcionarios, agentes, voluntarios y / o empleados, otros participantes, agencias patrocinadoras , patrocinadores, anunciantes y, si corresponde, propietarios y arrendadores de locales utilizados para llevar a cabo el evento ("RELEASES"), CON RESPECTO A CUALQUIER Y TODA LESIÓN, INCAPACIDAD, MUERTE, o pérdida o daño a la persona o propiedad, YA SEAN DE LA NEGLIGENCIA DE LOS COMUNICADOS O DE OTRA ÍNDOLE, en la máxima medida permitida por la ley.
6) De igual forma, otorga el permiso correspondiente para fines de autorizar a tomar fotos, grabar imágenes y otros procesos análogos de promoción que tenga a bien utilizar la empresa Metro Sports, LLC. Por la presente, autorizo ​​a MetroSports y a sus socios a usar mi imagen personal, nombre, fotos, video y otras representaciones de mí mismo para propósitos de comercialización relacionados con las ligas y los productos ofrecidos por MetroSports LLC.
7) Este relevo de responsabilidad se regirá por las leyes y los Tribunales del Estado Libre Asociado de Puerto Rico. En la eventualidad de que cualquier cláusula de este documento sea declarada nula o inválida, el mismo continuará en pleno vigor y efecto en todo aquello que no sea incompatible con aquella parte que hubiese sido declarada nula o invalida bajo la ley.
8) Este relevo de responsabilidad será vinculante para la parte y sus sucesores.
9) Reconozco que Metro Sports, LLC no me ha hecho promesas ni representaciones, más allá de las indicadas en este documento, y que si firmo el mismo no es por estar confiando en promesas o representaciones no incluidas en este escrito. Reconozco que asumo el riesgo de cualquier error de hecho, conocido o no, y que entiendo y reconozco el significado y las consecuencias de este documento, y represento que entiendo y voluntariamente acepto sus términos y condiciones.
10) Por lo tanto, en consideración a lo anterior, relevo y absuelvo a perpetuidad a Metro Sports, LLC por todos y cualquier reclamación, querella, acción, causas de acción en derecho o equidad, deudas, sumas de dinero, contratos, promesas y reclamaciones en daños que pueda tener, la sociedad legal de gananciales, si alguna, su cónyuge, sus herederos, albacea, administradores, sucesores en interés, cesionarios y dependientes puedan tener o hayan podido tener en el pasado en contra de Metro Sports, LLC por cualquier incidente que alegue sufriera daños y perjuicios.
11) El firmante reconoce y afirma que, después de haber tenido tiempo suficiente para leer cuidadosamente, entiende completamente todas las disposiciones de este documento, al igual que las consecuencias del mismo. Además, acuerda que no han dependido o descansado en ninguna representación o declaración hecha que no conste expresamente por escrito en éste, razón por la cual lo aceptan libre y voluntariamente.
